Kevin Hughes is a trial lawyer with over twenty years of experience handling complex commercial litigation matters.

He has served as lead counsel in successful jury trials in both federal and state court involving significant and highly complicated issues of real estate, lending, corporate finance, pharmaceuticals, technology and intellectual property. He has also handled multiple bench trials and arbitrations, and has successfully argued appeals before the California Court of Appeals and the Ninth Circuit.

Kevin’s recent successes include:

  • Obtaining a favorable jury verdict after a three-week federal trial in defense of FDIC suit against former directors of Northern California bank alleged to have stripped bank assets through a multi-million dollar dividend and stock repurchase.
  • Obtaining substantial fraud, product liability and punitive damages verdict after a month-long jury trial on behalf of a veterinary penicillin manufacturer against the nation’s third-largest seller of microbiological supplies.
  • Winning Ninth Circuit reversal of lower court ruling that Marin County owned copyright in client’s widely-used government records retention schedules as a work-made-for-hire. Click here to view the opinion.
  • Securing patent ownership and favorable settlement of trade secret claims on behalf of interactive media company after being brought in as new counsel six weeks before jury trial.
  • Successfully defended accounting and profit-sharing claims brought in arbitration by “Biggest Loser” reality show fitness guru and television producer against home entertainment company client.

He is licensed before all California courts, the United States District Court for the Central, Eastern, Northern and Southern Districts of California, and the United States Court of Appeals for the Ninth Circuit. He is a member of the California bar, the Association of Business Trial Lawyers and the Los Angeles Copyright Society. He has spoken before the Beverly Hills Bar Association and the International Council of Shopping Centers, and he has published articles in Los Angeles Lawyer Magazine, the Retail Law Strategist, Shopping Center Legal Update, the ABA Intellectual Property Newsletter and Computer & Internet Lawyer.

Before joining Foundation Law Group, Kevin was a litigator with Washington, D.C.–based Hogan & Hartson, and then in Los Angeles, with Greenberg, Glusker, Fields, Claman & Machtinger and Tisdale & Nicholson, LLP.

Kevin graduated from Columbia Law School in 1993, where he was a Harlan Fiske Stone Scholar and Articles Editor of the Columbia Journal of Law and Social Problems. He received his Bachelor of Arts Degree in 1990 from the University of Michigan (Ann Arbor), graduating with honors.

Kevin is active in the community serving as the Chairman of the Board of Advisors of the Male Success Alliance, a program through California State University Dominguez Hills for mentoring African-American and Latino men who are the first in their families to attend college. Previously, Kevin served for many years as the president of the Cheviot Hills Homeowners’ Association.

In his spare time, he writes fiction.
